The following document is on file in San Saba, Texas.  This transcription is taken from a transcription, not the original document.  It is to be noted, the person who transcribed this document previously, made errors in the name of the deceased.  J. D. (John) is often stated as C. D. (John).  I personally changed this to always state J. D. (John).

 

Affidavit of Heirship

J. D. Smelser et ux.

The State of Texas
County of San Saba:
Before me, the undersigned authority, on third day J. B. Harrell and W. H. Gregg, each known to me to be credible citizens of San Saba, Texas, each of whom after being by me duly sworn upon his oath deposes and says, and each deposes and says:
I was well and personally acquainted with J. D. (John) Smelser; that the following children, only, were born to-wit: J. R. Smelser; S. H. Smelser; A. Q. Smeler; W. H. Smelser; J. J. Smelser; Addie Smelser who intermarried with H. W. Sessom; Mollie Smelser, who intermarried with Joe Beck/ Lucille Smelser, who intermarried with F. L. Crawford, and Kate Smelser, who intermarried with ???? Fry; that all of said children are now living; that the said J. D. (John) Smelser departed this life in San Saba County, Texas, about the year, A.D. 1912, intestate, leaving his wife Mrs. C. F. Smelser and the above named children, as his only surviving heirs at law; that affiants were each well and personally acquainted with the said J. D. (John) Smelser and his wife, Mrs. C. F. Smelser, and their said children, and that no other issue were born of said marriage except as above named, and that the said Mrs. C. F. Smelser did not remarry after the death of the said J. D. (John) Smelser; affiants further depose and say that said T. H. Fry, husband of Kate Fry, died intestate on or about the ?? day of ?? A. D. 19??; that the said Kate Fry has not remarried since the death of her said husband; that, except as herein stated, each of the above named persons are now living and that the said Addie Sessom (nee Smelser), Mollie Beck (nee Smelser), and Lucile Crawford (nee Smelser) are each now living with their respective husbands hereinbefore named; that the said J. R. Smelser; S. H. Smelser; A. Z. Smelser; W. H. Smelser; J. J. Smelser, Addie Sessom, Mollie Beck, Lucile Crawford, and Kate Fry are the sole and only surviving heirs at law of the said J. D. (John) Smelser and Mrs. C. F. Smelser.

Your Petitioner Harmon Smelser respectfully showeth unto the county court that William Smelser died some time in the latter part of the year 1851 having property of a Perishable nature and that is in the condition that it required an immediate administration.

Your Petitioner therefore prays that the letters be granted to him in the aforesaid Estate with such powers as the case may require and in duty bound will ever pray.
